Talkio Kids Terms of Use

  • This is an agreement between Aidia ApS and the adult who installs Talkio Kids — not with the child.
  • The first two units are free. A subscription unlocks the rest and renews monthly until you cancel it in your store account.
  • Deleting the app or deleting local child data does not cancel a subscription.
  • Talkio Kids is an educational aid. We do not promise a particular learning outcome.
  • Nothing here removes a consumer right that cannot lawfully be waived.

These Terms of Use ("Terms") are an agreement between Aidia ApS ("Talkio Kids," "we," "us," or "our") and the adult parent or legal guardian who downloads, purchases, or permits a child to use the Talkio Kids mobile application ("you").

By downloading or using Talkio Kids, you agree to these Terms for yourself and on behalf of the child you authorize to use the app. If you do not agree, do not use the app.

1. About Talkio Kids

Talkio Kids provides short, guided language-learning activities for children approximately 7–10 years old. It is an educational aid, not a school, tutoring service, assessment, medical service, or substitute for professional advice. Learning outcomes vary, and we do not guarantee a particular result.

2. Adults and children

The app is intended to be installed, configured, and supervised by an adult parent or legal guardian. You represent that you are legally able to enter this agreement and authorize the child's use. Purchasing, subscription management, external links, privacy requests, and destructive data controls are for adults and appear in parent-facing areas.

No account is required. Do not attempt to add a child's real name, contact details, photographs, recordings, or other personal information to support messages or purchase identifiers.

3. License

Subject to these Terms and the applicable app-store rules, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Talkio Kids on compatible devices for private, non-commercial family use.

You may not:

  • Copy, sell, rent, sublicense, distribute, or commercially exploit the app or its content except as applicable law expressly permits.
  • Reverse engineer, decompile, bypass access controls, or derive source code except to the extent a non-waivable law permits it.
  • Interfere with the app, stores, purchase validation, or security features.
  • Use the app or its content unlawfully or to infringe another person's rights.
  • Remove proprietary notices or falsely imply affiliation with or endorsement by us.

4. Free content and Premium

Talkio Kids currently provides the first two learning units without charge. Talkio Kids Premium unlocks the remaining units and the Premium features shown on the purchase screen. We may improve, replace, or reorganize content while continuing to provide the ongoing value required for an auto-renewing subscription.

Before purchase, the app displays the localized price supplied by Apple or Google, billing period, renewal information, and links to these Terms and the Privacy Policy. Store pricing, taxes, currencies, trials, and eligibility may vary by country and store account. If a trial or introductory offer is shown, the terms displayed by the store at confirmation control that offer.

5. Auto-renewing subscriptions

If you purchase a monthly subscription:

  • Payment is charged to the Apple App Store or Google Play account at confirmation.
  • The subscription automatically renews each month unless it is cancelled through that store account.
  • The store may charge the renewal shortly before the next billing period in accordance with its rules.
  • Cancellation ordinarily takes effect at the end of the then-current paid period. Deleting Talkio Kids or deleting local child data does not cancel a subscription.
  • You can use Manage subscription in Parent corner or the store's account settings to manage or cancel.
  • Restore purchases can restore eligible access associated with the same store account.

Apple or Google, not Aidia ApS, processes the payment and controls store billing, cancellation, and refund tools. Refunds are handled under the applicable store rules and mandatory consumer law. Nothing in these Terms limits a non-waivable right to a refund, cancellation, remedy, or cooling-off period.

6. Privacy

Our Privacy Policy explains how information is handled. Learning progress stays on the device. Optional parent-controlled purchase services process purchase-related information as described there.

7. Local data and deletion

Talkio Kids stores the child's generic local profile and learning progress on the device. The gated Parent corner includes Delete local child data, which deletes that profile, progress, attempts, practice history, settings, and local reminder. Removing the app or clearing its storage may also delete this data. Unless a platform backup restores it, deleted local progress cannot be recovered.

Local deletion does not cancel a subscription or erase transaction records held by Apple, Google, or RevenueCat. Use the store's subscription tools and contact hello@talkio.ai for purchase-data privacy requests.

8. Permissions and device requirements

Optional speaking exercises require microphone and speech-recognition permission and a compatible on-device recognizer. The course remains usable if permission is refused or recognition is unavailable. Optional reminders require notification permission. Device manufacturers and operating-system providers control these permissions and may change their behavior.

You are responsible for a compatible device, store account, internet access needed for purchases, carrier or internet charges, and appropriate device settings and supervision.

9. Intellectual property

Talkio Kids, including its software, characters, artwork, animation, audio, curriculum, text, trademarks, and design, is owned by Aidia ApS or its licensors and is protected by intellectual-property laws. These Terms grant a license to use the app; they do not transfer ownership.

If you send feedback, you permit us to use it without restriction or payment, provided that we do not publicly identify you or a child without permission.

10. Availability and changes

We aim to provide a reliable app but do not promise uninterrupted or error-free operation. Features may depend on device capabilities, operating systems, stores, and third-party services. We may issue updates needed for security, compatibility, legal compliance, content improvement, or continued operation. Some updates may be required to continue using the app.

We may discontinue the app or a feature on reasonable notice where practicable, subject to applicable law and obligations to current subscribers. If a change materially affects a paid subscription, store rules and mandatory consumer rights continue to apply.

11. Suspension and termination

You may stop using the app at any time and may cancel a subscription through the applicable store. We may suspend or terminate access if you materially violate these Terms, interfere with purchases or security, or use the app unlawfully, subject to applicable law. Provisions that by their nature should survive termination — including ownership, disclaimers, liability limits, and dispute provisions — will survive.

12. Disclaimers

To the maximum extent permitted by law, Talkio Kids is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant a particular educational outcome.

These disclaimers do not exclude warranties or statutory guarantees that cannot lawfully be excluded, including applicable consumer protections.

13. Limitation of liability

To the maximum extent permitted by law, Aidia ApS and its directors, employees, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, goodwill, or opportunity, arising from the app.

Our aggregate liability arising from Talkio Kids will not exceed the greater of (a) the amount you paid for Talkio Kids during the 12 months before the event giving rise to the claim or (b) EUR 100.

This section does not limit liability that cannot lawfully be limited, including liability for fraud, willful misconduct, death or personal injury caused by negligence where applicable, or non-waivable consumer rights.

14. Governing law and disputes

These Terms are governed by the laws of Denmark, without regard to conflict-of-law rules. The courts of Denmark will have jurisdiction, except that consumers may bring claims in any forum and under any law that cannot validly be waived. In particular, a consumer resident in the EU may bring proceedings in the courts of their country of residence and benefits from the mandatory consumer-protection rules of that country.

Before filing a claim, please contact hello@talkio.ai so we can try to resolve the issue informally. This does not shorten or waive any statutory time limit or right to contact a regulator or court.

15. App-store terms

Your use is also subject to the applicable Apple or Google terms. If Talkio Kids is downloaded from Apple's App Store and Apple's standard end-user license agreement applies, that agreement supplements these Terms. To the extent required by Apple's terms:

  • These Terms are between you and Aidia ApS, not Apple.
  • Apple has no obligation to provide maintenance or support for the app.
  • Apple is not responsible for claims relating to the app except as required by law.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable app-store provisions.

If an app-store term conflicts with these Terms, the app-store term controls to the extent required for distribution through that store.

16. Changes to these Terms

We may update these Terms for legal, security, operational, or product reasons. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice or obtain agreement where required. Changes will not retroactively reduce non-waivable rights.

17. General

If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, sale, or by operation of law, subject to applicable privacy and consumer law. These Terms, the Privacy Policy, applicable purchase disclosures, and applicable store terms form the agreement concerning Talkio Kids.
